Human eSources, Ltd. (“Human eSources,” “we,” “our,” or “us“) respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes how we collect, process, retain, and disclose personal data about you when providing services to you through our TruTalent® website and service (collectively, the “Services”), which can be found at TruTalent.com, as well as when we interact with you in connection with our commercial sales and marketing activities, and our practices for using, maintaining, protecting, and disclosing that information.
This policy applies to information we collect:
- Through the Services
- In communications, including email, text, chat, and other electronic messages, between you and the Services.
- When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.
- In connection with our commercial sales, marketing, and customer relationship activities, including communications with business contacts at employers, recruiters, prospective clients, and business partners.
It does not apply to information collected by:
- Us through any other means, including on any other website operated by Human eSources or any third party that does not link to this policy; or
- Any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Services.
We may provide additional or different privacy policies that are specific to certain features, services, or activities.
Please read this policy carefully to understand our policies and practices regarding your information and how we treat it. By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this privacy policy.
This policy may change from time to time (see “Changes to Our Privacy Policy”). Your continued use of the Services after we make changes as described here is deemed to be acceptance of those changes, so please check the policy periodically for updates.
Types of Personal Data We Collect and How We May Share Your Information
“Personal data” is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, or device information.

How do we use this information?
We use and disclose the information and data we collect principally in order to provide our website and services as provided above, and to manage our commercial customer and prospect relationships. We may also use and disclose your personal data to:
- Communicate with you regarding our services and with respect to your questions and requests, including sending you newsletters and alerts;
- Market, sell, and promote our Services to businesses and organizations, including sending promotional communications (subject to applicable law and your preferences);
- Manage our relationships with employers, recruiters, and other business customers and partners, including administering their accounts and providing customer support;
- Operate our website, provide our services, and publish content;
- Distribute content to you in accordance with your preferences as well as provide other notifications to you (for example, updates about our policies and terms);
- Measure usage of the website and the Services;
- Provide for the safety and security of our website and services;
- Conduct research and similar activities to improve our websites and services;
- Comply with our legal and regulatory responsibilities and enforce our rights;
- In any other way we may describe when you provide your information;
- For any other purpose with your consent;
- To contractors, service providers, and other third parties we use to support our business operations, including professional advisors, web-hosting providers, analytics providers, customer-relationship management software providers, and other similar information technology providers. These service providers are contractually bound to protect your personal data and may only use it for the specific services they provide to us, in accordance with our written data processing agreements and applicable data protection laws;
- To our subsidiaries and affiliates, and in connection with the sale, assignment, merger, divestiture, restructuring, reorganization, dissolution, or other transfer of some or all of Human eSources’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by Human eSources is among the assets transferred;
- To any court, governmental authority, law enforcement agency, or other third party where we believe disclosure is necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights, the rights of any third party or individuals’ personal safety, or to detect, prevent, or otherwise address fraud, security, or safety issues;
- To enforce or apply our Terms of Service;
- To fulfill the purpose for which you provide it;
- To any other third parties where you have provided your consent.
Some of the information identified above may be considered sensitive data under certain laws. If required under applicable law, we will collect and process sensitive personal data only with your consent. If you choose not to provide or allow us to collect some information, we may not be able to provide you with requested features, services, or information.
Automated Decision-Making and AI. TruTalent uses automated processing, including artificial intelligence technologies, to match job seekers with potential employment opportunities based on a comparison of your qualifications, skills, and experience against job requirements provided by employers and recruiters. This matching process is designed to help connect you with relevant opportunities. Employers and recruiters who use our Services are contractually required to exercise their own independent judgment in all employment decisions—automated matching results are informational only and do not determine hiring outcomes. We also collect:
- Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific Services feature.
- Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), job postings that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.
If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal data.
Your Privacy Rights Under Applicable Law
Depending on where you reside, you may have certain rights regarding your personal data under applicable privacy laws. This section describes those rights and how to exercise them. These rights may be subject to limitations and exceptions under applicable law.
United States Residents
If you are a resident of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, or another U.S. state with applicable privacy legislation, you may have certain rights regarding your personal data, including:
- Right to Know/Access. You may request that we disclose to you the categories and specific pieces of personal data we have collected about you, the sources of that data, our purposes for collecting it, and the categories of third parties with whom we have shared it.
- Right to Delete. You may request that we delete personal data we have collected from you, subject to certain exceptions under applicable law.
- Right to Correct. You may request that we correct inaccuracies in the personal data we maintain about you.
- Right to Appeal. If we deny your privacy request in whole or in part, you have the right to appeal that decision. To submit an appeal, contact us at privacy@trutalent.com with the subject line “Privacy Request Appeal” within 45 days of receiving our decision. We will respond to your appeal within 60 days (or such other time period as required by applicable law). If your appeal is denied, we will provide information on how to contact your state attorney general or other applicable regulatory authority to submit a complaint.
- Right to Data Portability. Where technically feasible, you may request a copy of your personal data in a portable, readily usable format.
- Right to Opt Out. You may opt out of the sale or sharing of your personal data for employment matching purposes. Note: Because sharing your personal data with employers and recruiters is essential to our job matching services, opting out may significantly limit your ability to use the Services to find employment opportunities. - Right to Non-Discrimination. You have the right not to receive discriminatory treatment for exercising your privacy rights.
The categories of personal data we collect, the sources of that data, the purposes for collection, and the categories of recipients are described in the table above under “Types of Personal Data We Collect and How We May Share Your Information.”
California-Specific Disclosures. Under California law (CCPA/CPRA), “Personal Information” means information that identifies, relates to, or could reasonably be linked directly or indirectly with a California resident. In addition to the rights described above, California residents have the right to request disclosure of the specific pieces of personal information collected. We do not use or disclose sensitive personal information for purposes other than those permitted under the CCPA/CPRA. We may share personal information with employers and recruiters for employment matching purposes, which may constitute a “sale” or “share” under California or other applicable law. You have the right to opt out of such sales or sharing; however, doing so may limit your ability to use our Services for job matching. We do not share personal information for cross-context behavioral advertising.
Other U.S. States. Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws have similar rights as described above. The specific scope of these rights may vary by state. Please contact us if you have questions about the rights available to you under your state’s law.
International Residents
If you are located in the European Economic Area (EEA), United Kingdom, Switzerland, or another jurisdiction with applicable data protection laws, you may have additional rights regarding your personal data.
Our website and Services are directed solely towards users who reside in the United States. If you choose to use this website from outside the United States, you are consenting to the collection, storage, processing, and transfer of your information in and to the United States, pursuant to the laws of the United States.
We may process your Personal Data on the basis of:
- the need to perform a contract with you;
- our legitimate interests or those of a third party;
- the need to comply with the law; or
- any other ground, as required or permitted by law.
Notwithstanding the foregoing, similar to the processes described above, if you are located outside of the United States, Human eSources will honor the following requests from users:
- If the processing of Personal Data is based on your consent, the right to withdraw consent for future processing of that data.
- The right to request from Human eSources access to and rectification of your Personal Data.
- Subject to reasonable limitations, the right to request restriction of the processing of your Personal Data.
- Subject to reasonable limitations, the right to request erasure of your Personal Data.
Use of Cookies
A cookie is a small file placed on your device when you interact with the Services. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Services. Cookies help websites and online services function properly, remember user preferences, maintain secure sessions, and collect information about how the Services are used. Cookies may be either session cookies, which are deleted when you close your browser, or persistent cookies, which remain on your device until they expire or are deleted.
TruTalent uses cookies and similar technologies to support the operation, security, performance, and improvement of the Services. Some cookies are essential cookies, which are necessary for core functionality, such as maintaining secure sessions, enabling site operations, and remembering cookie preferences. For example, TruTalent may use a cookie such as consentedToCookies to record your cookie preference choices. These essential cookies cannot be disabled without affecting the availability or functionality of certain parts of the Services.
TruTalent also uses analytics and performance cookies to help us understand how users interact with the Services so that we can improve functionality, performance, and usability. These technologies may collect information such as pages visited, time spent on pages, and navigation paths within the Services. Analytics and performance tools used in connection with the Services may include Google Analytics, Google Tag Manager, and Pingdom or similar service providers.
In addition, TruTalent may use marketing and tracking cookies or similar technologies to support marketing, communications, and user engagement activities, including measuring campaign effectiveness and understanding interactions with the Services across sessions. These technologies may be provided by TruTalent or by third-party service providers, including Zoho Marketing Automation and other similar tools.
Some cookies and related technologies used on the Services are placed or operated by third-party service providers, including providers such as Google, Zoho, and Pingdom. These third parties may collect or process information in accordance with their own privacy policies and terms. TruTalent does not control third-party cookies or similar technologies except to the extent they are configured through our implementation of those services.
TruTalent may update its use of cookies and similar technologies from time to time to reflect changes in the Services, our practices, or applicable legal requirements. Continued use of the Services following any update constitutes acknowledgment of the revised terms, subject to any additional consent requirements imposed by applicable law.
To the extent any of these automated technologies are considered a personal data sale, targeted advertising, or profiling, under applicable laws, depending on where you live, you may opt out from use of these automated technologies for such uses by emailing your request to privacy@trutalent.com. Please note that some Services features may be unavailable as a result.

Your Rights and Choices About Your Information
This section describes mechanisms you can use to control certain uses and disclosures of your information and rights you may have under state law, depending on where you live.
Advertising, marketing, cookies, and other tracking technologies choices:
- Cookies and Other Tracking Technologies. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. If you disable or refuse cookies or similar tracking files, some Services features may be inaccessible or not function properly.
- Promotions by Human eSources. If you do not wish us to use your information to promote our own or third parties’ products or services, you can opt out by emailing your request to privacy@trutalent.com. You can also opt out by logging into your account and adjusting your account settings and preferences, or by clicking the “unsubscribe” link in any promotional email. Business Contacts who wish to opt out of receiving marketing communications may do so by contacting us at privacy@trutalent.com or using the unsubscribe mechanism in our emails.
Location data choices:
- Location Data. You can choose whether to allow the Services to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some Services features may become inaccessible or not function properly.
How We Protect Your Personal Data
We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Services. In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of personal data is at your own risk.
